01Who you are dealing with

This website is operated by Kevin Durham. In these terms that is “we” or “us”, and the person reading them is “you”.

Formal notices, and anything you would want a record of, should go through the contact form.

02Agreeing to these terms

Using this site means you accept these terms. If you do not accept them, the remedy is simple and immediate: stop using the site. Nothing here affects the rights you have as a consumer under UK law, which cannot be signed away and are not being signed away here.

03What this site is, and is not

It is a portfolio and a way to get in touch: work Kevin Durham has written, directed, performed or hosted, and a form for asking him to do more of it.

Nothing on this site is an offer capable of being accepted, and nothing on it forms a contract. In particular:

The site is written by a comedian and contains jokes, exaggeration, and at least one door that goes nowhere. Nothing on it is a statement of fact you should rely on for any decision, and nothing on it is professional advice of any kind.

04Everything here belongs to someone

The contents of this site — the writing, the photographs, the video, the audio, the design, the code, and the name “Kevin Durham” as used here — are owned by us or by our licensors, and are protected by copyright and other rights. Some material, such as film clips and podcast recordings, involves other rights-holders too.

You may read the site, watch and listen to what is on it, and share ordinary links to it. You may quote small extracts, with credit, where the law allows — for review, criticism, news reporting or quotation.

You may not, without written permission: copy, republish or redistribute any substantial part of the site; use anything from it commercially; alter anything from it and pass on the result; or strip out credits and rights notices. Requests are welcome and usually granted — ask through the contact form.

05No scraping, no AI training

We expressly reserve all rights in the contents of this site for the purposes of text and data mining, machine learning and artificial intelligence, including any reservation available under Article 4(3) of Directive (EU) 2019/790 and its equivalents.

Accordingly, you may not, without our prior written permission:

This is not decoration. Scripts and comedy writing are the work being advertised here, and permission to look at something is not permission to digest it.

07Using the site properly

You agree not to:

Serious misuse of a computer system is a criminal offence under the Computer Misuse Act 1990, and would be reported. We may also block access to the site from any address that is causing trouble, without notice and without explanation.

08The contact form

When you use the form, please give us details that are accurate, and do not send us confidential information or anybody else's personal information through it. It is a contact form, not a secure channel.

The form is protected by automated anti-spam checks, and messages that look automated are discarded without being read. Those checks are not perfect. If you have written to us and heard nothing, it is far more likely that a filter was overzealous than that you were ignored — try again, or reach us another way.

What we do with what you send is set out in the privacy notice.

09Unsolicited scripts and ideas

Please do not send us scripts, storylines, formats, characters, jokes or other creative material that we have not asked for. This is the ordinary practice in the industry and it protects both of us: comedy ideas converge, and a great many people have independently arrived at the same premise on the same afternoon.

If you send unsolicited creative material anyway, then to the extent the law allows:

You keep whatever copyright you have in your own work — sending it to us gives us no rights in it, and none of the above is a transfer of anything. If you want your material properly considered, say so first through the contact form, and if it makes sense we will agree how to do it on terms that suit us both.

10The upload page

There is a password-protected page for sending large files, for people who have been given the address and the password. If that is you:

We may withdraw access, change the password, or take the page down at any time.

11Availability

The site is provided free of charge and as it is. We do not promise that it will always be available, that it will be free of errors, or that anything on it is current — work moves on, and pages lag behind. We may change, suspend or withdraw any part of it, or all of it, without notice.

12Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. Your statutory rights as a consumer are unaffected.

Subject to that, and to the fullest extent the law allows:

If you are a consumer, this site is provided for private, domestic use, and we are not liable for business losses. If you use it for business purposes, we are not liable to you for the losses listed above at all.

13Privacy

What this site collects and why is set out in the privacy notice, which forms part of these terms. The short version: no analytics, no tracking, no cookies of our own, no mailing list.

14Changes to these terms

We may revise these terms. The version on this page is the one that applies, and the date at the top tells you when it last changed. Using the site after a change means accepting the revised terms, so it is worth glancing at the date if you are relying on something here.

15Law and courts

These terms, and any dispute arising out of them or out of your use of this site, are governed by the law of England and Wales. The courts of England and Wales have jurisdiction — except that if you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts there.
